GAN Nevada, Inc. (“GAN” or the “Sponsor”) is pleased to introduce the FALL GIVEAWAY SWEEPSTAKES! (the “Promotion”), in which eligible participants will have the chance to win Amazon eGift Cards and Bonus Credits  (for the amounts specified in Section 5(i)) in a series of separate weekly drawings (see time periods below), along with a final drawing from among all entries received in each of the separate weekly drawings. 

As a condition of participating in the Promotion, you agree to be fully and unconditionally bound by these Official Rules and the decisions of Sponsor, whose decisions shall be final and binding in all respects, and to waive any right to claim ambiguity in the Promotion, these Official Rules, promotional materials and information contained on any website or app offering the Promotion. Winning and receiving a Prize (as defined at Section 5(i)) are contingent upon fulfilling all requirements set forth herein.

1. ELIGIBILITY

To be eligible to participate in the Promotion, you must be a legal resident of the 50 United States, or DC, 21 years of age or older and have a registered online social or real money casino account (either account is also referred herein as “online casino account”) with a participating partner of the Sponsor (see list below).  

Void where prohibited by law. Directors, officers, employees, contractors, agents or representatives of the Sponsor, and each of their respective franchisees, parents, affiliated companies, subsidiaries, distributors, retailers, suppliers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of the Promotion, including, but not limited to, GAN, as well as their immediate family and individuals living in the same households, whether related or not, are not eligible to participate in the Promotion. “Immediate family members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. “Individuals living in the same household” shall mean those people who share the same residence at least three (3) months a year.

2. HOW TO ENTER

NO PURCHASE OR PAYMENT OF ANY KIND IS REQUIRED TO ENTER ANY OF THE DRAWINGS. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING IN ANY DRAWING. 

Beginning Monday, November 1, 2021 at 12:00:00 AM Eastern Time (“ET”) and ending on Tuesday, November 30, 2021 at 11:59:59 pm Eastern Time (“ET”) (“Promotion Period”), eligible individuals (“entrant” or “entrants”), as set forth in Section 1, may log in to their online casino account at their choice of one of the Sweepstakes Websites by clicking the fortune wheel to receive one (1) entry and entrants will have an opportunity to earn another entry on the same Sweepstakes Website after four (4) hours of the initial fortune wheel click. For clarification purposes, every four (4) hours begins when a Sweepstakes Website receives a click on the fortune wheel from an entrant and the same Sweepstakes Website will reset the timing four (4) hours later for the same entrant to earn another entry when he/she clicks the fortune wheel again, therefore each entrant can earn up to six (6) entries within 24 hours. Entries received on a given day will be entered into the corresponding weekly sweepstakes drawing (see timing chart below).  A “day” is defined by ET. Limit up to six (6) entries per eligible entrant per day.   Any attempt to enter more than six (6) times per day, whether by use of multiple names, email addresses, online accounts, or other means, is a ground for disqualification. If you have an online casino account at more than one of the Sweepstakes Websites, you will be associated with the first Sweepstakes Website you spin the fortune wheel on during the Promotion Period, and only your fortune wheel clicks at that same Sweepstakes Website will count during the remainder of the entire Promotion Period, regardless how many additional times you might login and click the fortune wheel on any other Sweepstakes Website(s). The entry period for each weekly drawing begins at 12:00:00 AM ET on the start date, and ends at 11:59:59 PM ET on the last date of the entry period as listed in the following chart: 

 

In the event of a dispute as to the identity of any entrant, the authorized account holder of the email address registered with the account used to submit the entry will be deemed to be the entrant. The “authorized account holder” is the natural person assigned the email address by the Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor reserves the right to require entrants to show proof of being the authorized account holder.

Eastern Time shall control for purposes of the Promotion. Sponsor or Sponsor’s designee’s computer shall be the official clock for purposes of the Promotion. Sponsor is not responsible for late or incomplete entries or transmission errors. Sponsor shall not be liable for any problems that occur during the entry process and shall not have any obligation to advise you of an incomplete, invalid or undeliverable entry. If a problem occurs in the entry process, you are solely responsible for verifying that the entry process has been validly completed. All entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Entrant is responsible for all online or data charges incurred with any Internet service provider and/or wireless carrier.

3. ENTRY CONDITION AND RELEASE

By entering, you agree to: (i) comply with and be bound by these Official Rules, and (ii) release, indemnify, defend, and hold harmless the Sponsor, and each of its respective franchisees, parents, affiliated companies, subsidiaries, distributors, retailers, suppliers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of the Promotion, including, but not limited to, GAN, and each of their respective past and present officers, directors, employees, agents, shareholders, contractors, representatives, tribal leaders and council-members (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability resulting or arising from the Promotion (including reasonable attorneys’ fees), including, but not limited to, negligence and damages of any kind to persons and property, invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright, or other intellectual property rights, property damage, or death or personal injury arising out of or relating to your entry, creation of an entry or submission of an entry, participation in the Promotion, acceptance, use, or misuse of a Prize, or the broadcast, exploitation, or use of an entry. Released Parties are also not responsible for any typographical or other error contained in the Official Rules or Promotion-related materials.

4. HOW THE PROMOTION WORKS

The Promotion consists of four (4) Promotional Entry Periods and five (5) promotional drawings as follows (each period begins at 12:00:00 a.m. ET on the listed start date and ends at 11:59:59 p.m. ET on the end date):

 

 

Entry into each of the initial four (4) weekly drawings is separate and must be received during the Promotional Entry Period for that drawing.   Entry for one (1) weekly drawing is not entry into any other weekly drawing, and entries do not roll over to subsequent weekly drawings.  All eligible entries from each weekly drawing, however, will be entered into the final drawing.  

If for any reason, there is a disruption or malfunction in performing the drawings, as determined in Sponsor’s sole and absolute discretion, the entrants may be contacted and notified of an alternate drawing at a later time or date nominated by Sponsor.

 

5. WINNER NOTIFICATION AND VERIFICATION 

On or about each drawing date, the winners in the applicable drawing will be contacted at the email address associated with their online casino account. The winners will be awarded the applicable Prize subject to verification of eligibility and compliance with all terms and conditions of these Official Rules to the Sponsor’s entire satisfaction. 

Except where prohibited, winners also may be required to sign and return to Sponsor, within five (5) business days from the date when Sponsor’s initial verification email was sent, a declaration of eligibility and liability/publicity release (“Declaration”) via email to the address specified in the Declaration in order to claim his or her Prize. If a potential winner fails to complete, sign and return the applicable Declaration within the required time period, or if the Declaration is returned as undeliverable or incomplete, the potential winner may be disqualified in Sponsor’s sole and absolute discretion. 

A winner may waive his/her right to receive a Prize. Sponsor shall have no responsibility or obligation to a winner or a potential prize winner who is unable or unavailable to, or who does not for any reason, accept or utilize a Prize. In the event a potential winner is disqualified for any reason, or if a Prize is unclaimed, the Prize will be forfeited. A forfeited Prize may be awarded to an alternate potential winner, in Sponsor's sole and absolute discretion.

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION FOR COMPLIANCE WITH THESE OFFICIAL RULES.  

 

(i) PRIZES AND PRIZE RESTRICTIONS

The prizes for the drawings (“Prizes”) and their approximate retail values (“ARV”) are as follows:

*All Bonus Credits awarded as prizes shall only be redeemable by the winner on the Sweepstakes Website via which the winner entered. 

 

The total ARV of the Prizes (each, a “Prize” and collectively, the “Prizes”) is $266,948.10 (USD).  The actual number of prizes awarded may be fewer than listed above if fewer entries are received from separate entrants for any drawing than the number of available prizes for such drawings. 

Limit one (1) Prize per winning entrant for each weekly drawing (regardless of the number of weekly drawings the entrant enters or the number of entries he/she has in any drawing), and one (1) Prize per entrant from the final drawing. Prizes will be awarded only if the potential winner fully complies with these Official Rules. All Prize details are at the sole and absolute discretion of Sponsor and any depiction of the Prizes, in promotional materials or otherwise, is for illustrative purposes only. Prizes are non-transferable, non-exchangeable, and non-refundable, and must be accepted by the winner as awarded. Upon any Prize dispute resulting from game play, entrants may file a ‘Prize Claim’ with the Sponsor addressed to Gan Nevada, Inc., 10801 W. Charleston Blvd., Suite 125 Las Vegas, NV 89135.   All gift card prizes are subject to the standard terms from the issuer of the gift card.   All Bonus Credit prizes are subject to the standard terms of use of the Sweepstakes Website via which the winner entered.  Amazon® is a trademark of Amazon, Inc.; and Amazon is not a sponsor of or associated in any way with this Promotion.  

A WINNER MUST SUPPLY SPONSOR WITH HIS OR HER SOCIAL SECURITY NUMBER FOR TAX PURPOSES IF THE TOTAL VALUE OF ALL PRIZES AWARDED TO SUCH PERSON IN ANY CALENDAR YEAR EXCEEDS $600.   SUCH WINNERS WILL RECEIVE BY EMAIL A 1099 TAX FORM, WHEN APPLICABLE, PROVIDED BY SPONSOR. ALL FEDERAL, STATE, AND LOCAL TAXES AND FEES ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNERS. ALL OTHER COSTS AND EXPENSES RELATED TO ANY PRIZE NOT SPECIFIED HEREIN AND OTHER EXPENSES INCURRED BY ACCEPTING THE PRIZE ARE ALSO THE SOLE RESPONSIBILITY OF THE WINNER. ANY REQUIRED TAX REPORTING FORMS WILL BE FURNISHED TO THE APPROPRIATE AUTHORITIES. 

(ii) ODDS OF WINNING

Odds of winning a Prize in any of the weekly drawings, or the final drawing, depend on the number of eligible entries received for that drawing. 

(iii) PUBLICITY

Unless otherwise prohibited by law, by participating in this Promotion, submitting an entry and/or accepting a Prize, entrant grants Sponsor and its designees the right to use entrant’s name, photograph, likeness, statements, biographical information, voice and city and state address for advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without compensation, review or approval rights, notification or permission, except where prohibited by law.

(iv) GENERAL CONDITIONS

By participating in the Promotion, entrant agrees to abide by and be bound by these Official Rules. Entrant further agrees to be bound by the Official Rules and decisions of the Sponsor and/or Administrator (as defined at Section 5(x) below), which are final and binding in all respects. Entrant also agrees to waive any rights to claim ambiguity of these Official Rules or any promotional materials. Failure to comply with these Official Rules may result in disqualification from the Promotion and forfeiture of any Prizes.

Sponsor reserves the right without liability to disqualify any entrant or cancel, suspend, modify and/or terminate the Promotion, or any part of it, for any reason, including, but not limited to, disruption of any stage of the Promotion, insufficient entries in the Promotion, any printing, seeding, typographical, technical errors, human or otherwise, suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Promotion or any other factor beyond Sponsor’s reasonable control, as determined by Sponsor at its sole and absolute discretion. In such event, Sponsor reserves the right to award the Prizes to the extent required by law for eligible entries submitted up to the time of the impairment (and/or thereafter), or in such other manner as deemed fair and appropriate by Sponsor at its sole and absolute discretion. 

ANY ATTEMPT BY ANY PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO NOT ONLY DISQUALIFY SUCH INDIVIDUALS BUT TO SEEK CIVIL AND/OR CRIMINAL PROSECUTION AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

(v) LIMITATIONS OF LIABILITY

To the maximum extent permitted by law, the Released Parties are not responsible for: (i) any incorrect or inaccurate information, whether caused by entrants, technical errors, or by any of the equipment or programming associated with or utilized in the Promotion; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections of the equipment or software associated with or utilized in the Promotion; (iii) unauthorized human and/or mechanical intervention in any part of the entry process or the Promotion; (iv) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt, use or misuse of the Prize. If for any reason your entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is to submit another entry during the Promotion through the methods set forth in these Official Rules.

(vi) DISPUTES 

To the extent allowed by applicable law, you agree that: (i) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or the Prizes shall be resolved individually without resort to any form of class action, by the United States District Court, District of Nevada or the appropriate Nevada State Court located in Clark County, Nevada; (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but will in no event include attorneys’ fees; and (iii) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Nevada, without giving effect to any choice of law or conflict of law rules (whether of the State of Nevada or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Nevada.

(vii) EXTENDED MEANINGS; CURRENCY; FORCE MAJEURE

Unless otherwise specified in these Official Rules, words importing the singular include the plural and vice versa and words importing gender include all genders. All dollar amounts referred to in these Official Rules are in lawful money of the United States of America. Sponsor is not responsible for any damages caused by delay or failure to perform undertakings pursuant to these Official Rules when the delay or failure is due to weather, event cancellations, epidemics, pandemics, fires, strikes, floods, acts of God or the state’s enemies, lawful acts of public authorities, delays or defaults caused by common carriers, or other events that cannot reasonably be foreseen or provided against.

(viii) OFFICIAL RULES AND WINNERS’ LIST

Official Rules are available at each Sweepstakes Website. To obtain a list of winners, you may mail a self-addressed, stamped envelope to GAN Nevada, Inc., Attention WINNERS LISTS Fall Giveaway Sweepstakes November 2021, C/O Tim Aguilar, 400 Spectrum Center Drive, Suite 1900, Irvine, CA, 92618. The list of winning entries will be available after February 2, 2022, and requests must be received no later than four (4) months after the Promotion ends.
